Terms of Service
Last updated: July 2026
1. Acceptance of Terms
By accessing or using MarketingOS (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not use the Service. These Terms apply to all users, including paying clients and their authorized team members.
2. Description of Service
MarketingOS provides a demand-generation platform that helps brands manage leads, outreach, content, and research workflows. The Service may include AI-assisted features, analytics dashboards, and integration capabilities.
3. Accounts & Access
You are responsible for safeguarding your account credentials. You agree not to share your login with unauthorized individuals and to notify us promptly of any unauthorized access. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Client Data & PII
Clients may upload or generate personal data (e.g., lead emails and phone numbers) through the Service. MarketingOS acts as a data processor on behalf of the client (the data controller). Clients remain responsible for obtaining appropriate consent from data subjects before importing their information.
5. Acceptable Use
You may not use the Service for any unlawful purpose, to transmit malicious content, or to attempt to gain unauthorized access to any system. Automated scraping, reverse engineering, or redistribution of the Service is prohibited without prior written consent.
6. Fees & Billing
Access to certain features requires a paid subscription. Fees are billed in advance on a recurring basis. Failure to pay may result in suspension of the affected brand's account. Refund policies, if any, are communicated separately in your order form or invoice.
7. Intellectual Property
All intellectual property rights in the Service remain with MarketingOS. Content generated by clients through the Service belongs to the respective client, subject to our right to use aggregated, anonymized data for product improvement.
8. Limitation of Liability
To the maximum extent permitted by law, MarketingOS shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the fees paid by you in the twelve (12) months preceding the claim.
9. Termination
Either party may terminate the relationship by providing written notice. Upon termination, the client may request a data export; once fulfilled, all stored data will be permanently deleted in accordance with our Data Processing Addendum.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict-of-law principles. Any disputes shall be resolved through binding arbitration.
11. Changes to Terms
We may modify these Terms from time to time. Updated Terms will be posted on this page with a revised “Last updated” date. Continued use of the Service after changes constitutes acceptance.
